Enterprise Estonia (hereinafter “EE”) offers via the webpage brand.estonia.ee and toolbox.estonia.ee instructions and materials for introducing and promoting Estonia, including story, core and thematic messages, verbal and visual language, typeface Aino, a photo and video library, infographics, icons, presentations and other works.
EE gives the right to use Brand Estonia’s materials if you follow the conditions of use.

If you cannot determine, whether the usage is in accordance with the conditions of use, send an e-mail to the following address: brand@estonia.ee.

If you wish to create a new visual identity or a large scale creative brief in the public sector using Brand Estonia, please contact brand@estonia.ee.

General provisions

General provisions

1. Application of the conditions of use

The terms and conditions set out in this section (general provisions) apply to all users in regard to all materials. Special conditions for uploaders of materials and conditions for the use of specific material (typeface Aino, word marks, photo, video, etc.) are set out in the corresponding section of the conditions of use.

2. Definitions

2.1. Typeface Aino – official typeface of Brand Estonia, commissioned by a team comprising the best design and communication professionals in Estonia (hereinafter “the Estonian Design Team”). Conditions for the use of typeface Aino are set out in section II of the conditions of use;
2.2. Author – a natural person who creates materials, uploads them to the website and allows them to be downloaded for free;
2.3. EE – Enterprise Estonia;
2.4. Brand Estonia – messages and materials for introducing Estonia, created by the Estonian Design Team in 2016;
2.5. User – a natural or legal person or establishment who downloads materials from the website and/or uploads materials to the website.
2.6. Conditions of use – these conditions of use;
2.7. Account – a user account through which the user identifies himself/herself and which is needed to upload or download materials;
2.8. Word marks – marks with a specific graphical shape that create a connection between Estonia and a desired area. Conditions for the use of word marks are set out in section III of the conditions of use;
2.9. Materials – instructions and materials offered via the website of EE for introducing and promoting Estonia, which include core messages, the story, values, typeface Aino, photos, videos, infographics, icons, presentations and other works;
2.10. Use of materials – downloading materials from the website and the subsequent use thereof;
2.11. Downloading of materials – transfer of materials from the website to the user’s workstation;
2.12. Uploading of materials – adding materials to the website, thus providing other users an opportunity to use the materials;
2.13. Website – brand.estonia.ee and its sub-page toolbox.estonia.ee.

3. Account

3.1. Creation of an account is a prerequisite for using the materials. To create an account, fill out the registration data (including e-mail address and a password, which we will use to identify you whenever you use the website).
3.2. The precondition for creating an account is agreeing with the conditions of use.
3.3. To register an account, a natural person or the representative of a legal person or an establishment has to have an active legal capacity.

4. Obligations of the user

4.1. You shall ensure that you use the website and the materials according to the conditions of use. If you cannot determine, whether the use is in accordance with the conditions of use, send an e-mail asking for clarification to the following address: brand@estonia.ee.
4.2. You shall keep the username and password of your account safe and confidential. Disclosure of the password to third parties, thus allowing third parties to use the account, is considered a breach of the confidentiality of the password. A third party is deemed to be any natural person other than the user. You are responsible for any breach or damage caused or any action that is taken using your user password and account. You must immediately notify EE of any breach of security or unauthorised use of your account.
4.3. You shall to refrain from disturbing or damaging the website. Among other things, you are prohibited from:
___4.3.1. modifying or using the website for advertising or public display, performance, sale or rental purposes;
___4.3.2. decompiling, reverse engineering, disassembling or modifying the website;
___4.3.3. removing any proprietary or other material notices or data or documents from the website;
___4.3.4. data mining the website or hacking, automatically browsing or tracking it;
___4.3.5. forwarding junk mail, mass data or unwanted information;
___4.3.6. falsifying headers or otherwise changing identifiers (including URLs) to conceal the origin of the material published on the website;
___4.3.7. misrepresenting your affiliation with any person or entity;
___4.3.8. obstructing the normal exchange of information or otherwise behaving in a manner that interferes with the ability of the website users to use the website;
___4.3.9. engaging in any activity that would violate any relationship of trust, any applicable local, national or international laws or other regulations, including compromising the security of any related accounts or websites, conducting illegal lottery or gambling operations, tracking or threatening with violence;
___4.3.10. collecting personal information from other users unless the users have given you permission. In this case, EE is not be liable for the processing of personal data by you;
___4.3.11. collecting or storing data on the website for any purpose that is inconsistent with the conditions of use.
4.4. The user undertakes to immediately notify EE of any infringement of the rights to use the materials by third parties discovered by the user.
4.5. Use of the website involves a license, not a transfer of ownership. You do not become the owner of the materials nor obtain the database rights of the website or material library.

5. Rights of EE

5.1. EE reserves the right to modify, suspend or discontinue the services (or any part thereof) provided on the website at any time, and/or to terminate your access to the website without notice. EE may also restrict or suspend access to information and files. EE is not liable before you or any third party for any modification, suspension or termination of the information or services.
5.2. EE may terminate your account unilaterally and without prior notice and may withdraw your right to use the website at any time if you violate the conditions of use.
5.3. EE may change the conditions of use at any time without prior notification of the users. Changes to the conditions of use will be announced on the website.

6. Indemnification and lack of warranty

6.1. The website is intended for sharing materials between the EE, the author and users. EE provides a platform through which authors can share materials with the users. EE provides no warranty and takes no liability for any materials uploaded by the authors. EE is not responsible for the existence of the consent of the persons depicted in the materials. The authors are solely responsible for the materials they upload or otherwise distribute on the platform. At the request of EE, the author shall prove the existence of consent. If EE suspects that the persons depicted in the materials have not given consent, EE reserves the right to remove such material from the platform without prior notification of the author.
6.2. You accept that EE is not liable for any damages (including material, non-material damage, loss of earnings) arising from any legal basis (including contractual relationship, non-contractual legal relationship) in connection with the use of the materials.
6.3. You confirm that you agree to exempt EE from liability and to protect and hold EE harmless from any liability or claims arising out of or related to the misuse of the website or the materials or use of the materials by users. EE makes reasonable efforts to ensure that the materials, information and data on the website are accurate and reliable, but EE does not guarantee their accuracy or reliability. EE shall maintain the website as it is.

7. Cancellation

7.1. EE may cancel the licence at any time by notifying you of thereof 30 days in advance. EE is not liable for any loss or damage resulting from the cancellation of the licence.
7.2. EE has the right to cancel the license without prior notice if you continue to violate the terms of use despite the fact that EE has drawn attention to this.
7.3. If EE has cancelled the license, you are obligated to immediately terminate the use of the materials and destroy all copies of the materials in your possession or under your control.

8. Contractual penalty

8.1. If EE has pointed out that the user violates the terms of use of typeface Aino, word marks or materials, and the user does not terminate the infringing activity, EE has the right to demand termination of the use of typeface Aino, word marks or materials and a contractual penalty of 2,000 euros for each violation.
8.2. EE has the right to demand a contractual penalty within 12 months from becoming aware of the violation.

9. Other terms and conditions

8.1. The legal relationships arising out of the use of this website are governed by the laws of the Republic of Estonia irrespective of the user’s country of residence or location.
8.2. Any disputes will be settled by means of negotiations. If unresolved, the disputes shall be settled in Harju County Court.
8.3. All notices of EE shall be sent to the e-mail address you gave to EE when you created or updated your user account.

Use of typeface Aino

Use of typeface Aino

10. Copyrights

10.1. The material copyrights of typeface Aino belong to EE.
10.2. EE grants users the right to use typeface Aino for free, indefinitely and freely under a non-exclusive non-transferable license, without geographic restrictions.
10.3. The user has the right to use typeface Aino in its predetermined form. The user does not have the right to modify the typeface.
10.4. It is prohibited to use typeface Aino:
10.4.1. for creating logos and word marks (including registration as a trademark or industrial design solution);
10.4.2. in a manner and context that is inappropriate, malicious, amoral, defamatory, racist, violent, offensive, harassing, or otherwise in conflict with public order or good morals, or does not conform to general good taste.
10.5. The non-exclusive license for material rights of typeface Aino is valid in all countries of the world without any technical or creative restrictions. The non-exclusive licence involves all technical uses known today and those existing in the future.
10.6. The license is included with each download or actual use.

Use of word marks

Use of word marks

11. Copyrights

11.1. The material copyrights of word marks belong to EE.
11.2. EE grants users the right to use word marks for free, indefinitely, without geographic restrictions under a non-exclusive non-transferable license in a manner and under the terms and conditions set out in the conditions of use (see clauses 12 and 13).
11.3. The user has the right to use the word marks in their predetermined form, including enlarging and reducing them. Other modifications or deviating from their intended use or changing the content is not allowed.
11.4. The user may not sub-license or sell word marks under the license they receive. Moreover, it is prohibited to use word marks for the creation of databases
11.5. If word marks are to be used by third parties, the word marks must be downloaded only through the brand.estonia.ee website. Making word marks available to the public via databases, FTP servers, cloud services or other similar manner is prohibited.
11.6. The license is included with each download of a word mark or its actual use.

12. Acceptable use

12.1. The user has the right to use word marks to introduce a specific area of Estonia to potential or existing foreign partners or guests.
12.2. The use of word marks on souvenirs is allowed, provided that the design of the souvenirs has been approved in advance by EE (please send a corresponding application to brand@estonia.ee).

13. Unacceptable use and manner of use

13.1. Word marks may not be used for a purpose which is inconsistent with clause 12 of the conditions of use. It is prohibited to use word marks, inter alia:
___13.1.1. in advertising campaigns and marketing activities aimed at selling a specific product or service, without the prior permission of EE;
___13.1.2. on websites, in publications, TV commercials, and other advertising media of individuals, businesses, or third sector companies that are aimed at selling a specific product or service, without the prior permission of EE;
___13.1.3. to present or mark specific products or services;
___13.1.4. on the symbol or the word mark of a product or service (including registration as a trademark or industrial design solution);
___13.1.5. in a context unrelated to Estonia.
13.2. It is prohibited to use word marks in a manner and context which:
___13.2.1. violates Estonian or international law;
___13.2.2. is inappropriate, malicious, amoral, defamatory, racist, violent, offensive, harassing, or otherwise in conflict with public order or good morals, or does not conform to general good taste;
___13.2.3. damages or may damage the concept and integrity of Brand Estonia;
___13.2.4. belittles Estonian companies, society, products or services.

14. The right to create new word marks and to stop publishing word marks

14.1. Only EE has the right to create new word marks. The user does not have the right to create new word marks.
14.2. EE may stop making the word marks available to the public.

15. General

The conditions of use set out in this chapter do not apply to the use of typeface Aino and word marks. The conditions of use set out in this chapter apply to all other materials on the website, including photos, videos, audio, illustrations, icons, presentations, and print.

16. Copyrights

16.1. Enterprise Estonia gives to users the right to use materials for free without geographic restrictions under a non-exclusive non-transferable license in a manner and under the terms and conditions set out in the conditions of use (see clauses 17 and 18).
16.2. The user has the right to use the materials within the term indicated on the website by the material. If no end date is stated by the material, the user has the right to use the materials until the materials are available on the website, in which case the license granted to the user is terminated by removal of the materials from the website by EE.
16.3. The user has the right to use the materials in their predetermined form, including enlarging and reducing them. Materials may only be modified if the end result still complies with the brand design guidelines: https://brand.estonia.ee/et/disain/.
16.4. The user may not sub-license or sell the materials under the license they receive. Moreover, it is prohibited to use the materials for the creation of databases Making materials available to the public via databases, FTP servers, cloud services or other similar manner is prohibited.
16.5. The license is included with each download of a material or its actual use.

17. Acceptable use and manner of use

17.1. The user has the right to use the materials to introduce Estonia, Estonian society or Estonian economic spheres. The use of materials in Estonia is permitted, provided that the primary purpose of the use of the materials is directed to potential or existing foreign partners or guests. The use of the materials for any other purpose is permitted only with the prior permission of EE (please send the corresponding application to brand@estonia.ee).
17.2. The use of materials on souvenirs is allowed, provided that the design of the souvenirs has been approved in advance by EE (please send the corresponding application to brand@estonia.ee).

18. Unacceptable use

18.1. Materials may not be used for a purpose which is inconsistent with clause 17 of the conditions of use. It is prohibited to use the materials, inter alia:
___18.1.1. in advertising campaigns and marketing activities aimed at selling a specific product or service, without the prior permission of EE;
___18.1.2. on websites, in publications, TV commercials, and other advertising media of individuals, businesses, or third sector companies that are aimed at selling a specific product or service, without the prior permission of EE;
___18.1.3. to present or mark specific products or services;
___18.1.4. on the symbol or the word mark of a product or service (including registration as a trademark or industrial design solution);
___18.1.5. in a context unrelated to Estonia.
18.2. It is prohibited to use materials in a manner and context which:
___18.2.1. violates Estonian or international law;
___18.2.2. is inappropriate, malicious, amoral, defamatory, racist, violent, offensive, harassing, or otherwise in conflict with public order or good morals, or does not conform to general good taste;
___18.2.3. damages or may damage the concept and integrity of Brand Estonia;
___18.2.4. belittles Estonian companies, society, products or services.

19. Liability of the user

The user is responsible for all claims of intellectual property infringement and claims made by the persons depicted in the materials.

20. User responsibility for the publication of materials

When publishing the materials, the name of the author should be indicated where possible (e.g. the given name and surname of the author of the photo/video).

Uploading materials to the website

Uploading materials to the website

21. General

You and other users may add materials to the website through the website. Make sure you have the necessary rights and consents to add materials to this website. By uploading materials to the website, you agree to the conditions of use and confirm that you have the rights and consents required to add the materials. Among other things, you agree that your uploaded material is visible to other users of the website and available for download and use.

22. Uploading materials

22.1. You are solely responsible for the materials you upload to the website as well as for their legality. You agree to not upload any materials that:
___22.1.1. violate any international or domestic law;
___22.1.2. are inappropriate, malicious, amoral, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise in conflict with public order or good morals or manners;
___22.1.3. infringe upon the intellectual property rights of any person or the creation of which involved processing of personal data without the consent of the data subject;
___22.1.4. contain software viruses, spam, malware, or any computer code, files, or programs that may interfere with, damage, corrupt, destroy, or impair the performance of computer software or hardware or telecommunications equipment;
___22.1.5. contain unauthorised third-party commercial advertisements;
___22.1.6. do not conform to general good taste.
22.2. EE reserves the right to modify or remove materials that violate the above terms.

23. Licence

23.1. Upon uploading materials, you grant EE a non-exclusive licence to use all material copyrights of the materials, including the right to:
– reproduce in publications and visual design;
– distribute;
– make available to the public in printed, moving and outdoor advertisements, presentations, on webpages, social media, video blogs and other electronic mediums;
– transmit through television and radio;
– retransmit through cable networks;
– translate and add subtitles;
– make adaptions, modifications (arrangements) and other modifications (the right to modify the work);
– use in compilations and catalogues;
– present in public;
– exhibit;
– make derived works and arrangements.
23.2. In the case of audiovisual materials, upon uploading materials, you grant EE a non-exclusive licence to use all material rights of the performer, including the right to:
– transmit the performance through radio, television or satellite;
– direct the performance to the public using any technical device;
– make the recording of the performance available to the public;
– use the video of the performance separately from the sound;
– reproduce the recording of the performance directly or indirectly, temporarily or constantly, partially or fully in any form or manner;
– make the recording available to the public through webpages, social media, video blogs and other electronic mediums;
– rent and lend the recording of the performance.
23.3. In the case of audiovisual materials, upon uploading materials, you grant EE a non-exclusive licence to use all material rights of the film producer, including the right to:
– reproduce the first fixation of film in any form or matter;
– import the copies of the first fixation of film;
– make the first fixation of the film available to the public through webpages, social media, video blogs and other electronic mediums;
– rent or lend the copies of the first fixation of the film;
– make the first fixation of the film available to the public.
23.4. Upon uploading materials, you grant EE a non-exclusive licence to use all personal material copyrights of the materials and performances included in the materials, including the right to:
– alter and process the material and presentations and contest modifications made thereto without the author’s consent;
– add other works and performances;
– publish the material or part thereof at the time, under terms and conditions and to the extent determined by EE.
23.5. Non-exclusive licence related to the moral and material copyrights of the author and performer is valid indefinitely in all countries of the world without any technical or creative restrictions. The non-exclusive licence involves all technical uses known today and those existing in the future.
23.6. You grant EE a non-exclusive licence free of charge.
23.7. You agree that EE has the right to publish, distribute, reproduce, transmit, and retransmit the materials uploaded to the website, as well as make them available to the public, and give third persons the right to use the materials and create derived works and modifications. EE does not have to coordinate with you neither the extent of using the materials nor the conditions for their publishing, distributing, reproducing, transmitting, retransmitting, and making them available to the public.
23.8. EE can (use the moral copyright) make modifications and additions to the materials, add new works and performances, including reassembling the audiovisual works, according to the creative and technical conditions determined by EE. EE can grant third persons the right to modify and enhance the materials as well as create additions. EE has the right to decide when the materials are ready to be published, and alongside which works and performances the materials are to be published (including creation of compilations). The starting date of using the materials may be longer than one year from the uploading of the materials. EE can choose in which commercial campaigns the materials are used without prior notification of the user who uploaded the materials.
23.9. By uploading materials, you authorise EE to grant sub-licenses (non-exclusive licenses) to other users of the website for the purposes set out in the conditions of use.
23.10. You confirm that you own the material copyrights of the authors, performers, producers of phonograms and first fixation producers of the materials uploaded to the website and that you have the right to grant EE and the users of the website the moral copyrights of the materials and performances. You confirm that the materials include no other works, performances, recordings or trademarks for the use of which EE has to enter into additional agreements. The audiovisual works do not include musical works in respect of which Enterprise Estonia has to sign additional agreements with authors, performers, producers of phonograms and/or collective management organisations, or pay remuneration for the use of musical works and recordings.
23.11. You confirm that persons who are recognisable in the materials have given their consent to using their image in the materials as well as to distributing such photos and audiovisual works and making them available to the public. At the request of EE, you must provide proof of people’s consent.
23.12. EE has no ownership rights to the materials on the website and therefore no obligations with respect to the materials. The materials you upload to the website are provided to users free of charge.

24. Specifying and changing the type of materials

24.1. EE reserves the right to manage, modify or remove materials unilaterally, without prior notice and for any reason.
24.2. EE uses several categories (such as “people”, “nature”, etc.) to categorise the materials. By accepting the conditions of use, the author grants EE the right to unilaterally categorise the materials.

25. Rights and obligations of the author

25.1. You have the right to upload materials that you own or are authorised to use and distribute.
25.2. Authors should always have copies of their uploaded material. The files of authors uploaded to the website cannot be used for backup purposes.
25.3. By uploading materials to the website, the author confirms that he/she has the right to grant EE a worldwide, royalty-free, non-exclusive license of the materials on any known or future medium under the terms and conditions set out in clause 23.
25.4. The author retains ownership of all materials uploaded to the website and all other rights, subject to the terms and scope of the non-exclusive license granted to EE.
25.5. The author confirms that by downloading materials uploaded by the author to the website, the user is granted a license to use the materials in accordance with the conditions of use. The materials do not belong to the users and the use of the materials is permitted only in accordance with the conditions of use. A non-transferable non-exclusive license for the use of the materials is granted to the users only when they download the materials from the website. The author retains ownership of the materials downloaded by the user.
25.6. The author undertakes to provide EE with data and documents (including bringing them to EE, if necessary) in order to prove or assert his/her rights.

26. Personal data related to user accounts are processed pursuant to the conditions for data processing of Enterprise Estonia.
